These Communications Terms and Conditions (“Communications Terms”) govern all marketing, promotional, informational, transactional, and customer service communications (“Communications”) we send you from Make The Impact (“we,” “us,” or “our”), including but not limited to:
  • Email messages
  • SMS/MMS text messages
  • Phone calls (live, automated, or prerecorded)
  • Website push notifications or in-browser alerts (if enabled)
  • Other digital channels (e.g., chat, social media direct messages where initiated by us)
By providing your contact information (e.g., email, phone number) through our website forms, quote requests, signups, events, or other interactions, and agreeing to receive Communications (via checkbox, explicit consent, or continued engagement), you consent to these Communications Terms and our Privacy Policy.

 

1. Program and Communications Description

We may send you recurring Communications about our services (website design, payment processing, email marketing, marketing consulting, brand photography, quotes, updates, promotions, reminders, support, and impact-related news). These may include promotional/marketing content, service updates, or transactional messages.
Communications may use automated systems, including automatic telephone dialing systems (ATDS/autodialers), artificial or prerecorded voices for calls/texts, or automated email tools.
Message/call frequency varies (e.g., 1–15 per month, depending on your interactions and campaigns). We do not guarantee any specific frequency and reserve the right to adjust it.
 

2. Consent

  • Consent is not a condition of purchase or any transaction with us.
  • By providing your email, phone number, or other contact details and agreeing to receive Communications (e.g., checking a consent box stating “I agree to receive marketing emails, texts, and calls – see our Communications Terms and Privacy Policy”), you provide your prior express written consent to receive automated/marketing Communications as described.
  • For email: You consent to marketing emails under CAN-SPAM rules.
  • For phone/SMS: This satisfies TCPA requirements for prior express written consent to autodialed/prerecorded marketing calls/texts to your wireless number.
  • You represent that you are the subscriber/customary user of the provided contact details and authorized to consent.

3. Message and Data Rates; Carrier Support

Message and data rates may apply for SMS/MMS and phone calls. Check with your carrier/provider. We are not responsible for carrier-imposed fees.
We support major US carriers (e.g., AT&T, Verizon, T-Mobile, Sprint) for SMS/calls. Delivery is not guaranteed in all areas or on all networks.
 

4. Opting Out and Revoking Consent

You may revoke consent and stop receiving Communications at any time through these methods (we honor revocations promptly, typically immediately and no later than 10 business days per FCC/TCPA rules):
  • Email: Click the “Unsubscribe” link at the bottom of any marketing email.
  • SMS/Text: Reply STOP, UNSUBSCRIBE, END, QUIT, CANCEL, OPT OUT, or a similar reasonable keyword to any text message. (We also honor other reasonable opt-out replies per FCC “reasonable reply” rules effective 2025.)
  • Phone Calls: Follow verbal opt-out instructions if provided, or contact us afterward.
  • General: Email us at support@maketheimpact.com, use our website contact form, or reply “STOP”/“UNSUBSCRIBE” in other digital channels where applicable.
After opt-out:
  • You will receive a confirmation (e.g., one final email/text confirming revocation).
  • We will apply your opt-out across channels where feasible (e.g., a text STOP typically stops SMS; email unsubscribe stops marketing emails).
  • Opt-out applies to marketing/promotional Communications; we may still send essential transactional/service messages (e.g., order confirmations, account alerts) unless prohibited by law.

5. Your Responsibilities and Our Rights

  • Provide accurate contact information and notify us of changes.
  • We reserve the right to modify, suspend, or terminate any Communications program/channel without notice.
  • We may update these Communications Terms; continued receipt after posting changes constitutes acceptance.

6. Limitations and Disclaimers

  • Communications may be delayed or undelivered due to technical/carrier issues beyond our control.
  • These Communications Terms are governed by Ohio law, without regard to conflict principles.
